Candidate Terms & Conditions

These Candidate Terms & Conditions (“Agreement”) govern your use of the recruiting and placement services provided by Ferrer & Co. (“Company,” “we,” “our,” or “us”). By submitting information to the Company, using our website, applying for opportunities, participating in interviews, or otherwise engaging with our recruiting services, you (“Candidate,” “you,” or “your”) agree to the following terms.

1. Recruiting Services

The Company provides recruiting, candidate sourcing, referral, and placement services for construction and related industries. Our services may include:

  • Reviewing candidate qualifications

  • Connecting candidates with employers

  • Facilitating interviews and communications

  • Coordinating hiring processes

  • Providing recruiting-related support and follow-up

The Company does not guarantee placement, employment, compensation, duration of employment, job availability, interview requests, or hiring outcomes.

2. Candidate Eligibility

By using our services, you represent and warrant that:

  • You are at least 18 years old;

  • All information you provide is accurate, truthful, and complete;

  • You are legally authorized to work in the United States;

  • You possess any licenses, certifications, or qualifications you claim to hold;

  • You will promptly update us regarding any material changes to your employment status, qualifications, or contact information.

Providing false, misleading, or fraudulent information may result in removal from our recruiting system and may be reported where legally required.

3. No Employment Relationship

The Company is an independent recruiting and referral service.

Unless explicitly stated otherwise in writing:

  • The Company is not your employer;

  • The Company does not supervise your work;

  • The Company does not control your wages, schedule, hours, benefits, or working conditions;

  • Any employment relationship is solely between you and the hiring company.

The Company is not responsible for workplace conditions, payroll practices, safety procedures, management decisions, disciplinary actions, termination decisions, or employment-related disputes involving third-party employers.

4. Candidate Information & Resume Submission

By submitting your resume, application, contact information, employment history, certifications, or other materials to the Company, you authorize us to:

  • Review and store your information;

  • Share relevant information with prospective employers;

  • Contact you regarding opportunities;

  • Communicate with employers regarding your qualifications;

  • Retain recruiting records for legitimate business purposes.

You acknowledge that employers may independently verify your qualifications, references, certifications, employment history, background information, or licensing.

The Company reserves the right to decline representation or discontinue recruiting efforts at its discretion.

5. Confidentiality

The Company will use commercially reasonable efforts to handle candidate information professionally and confidentially.

However, you understand and acknowledge that:

  • Information submitted for recruiting purposes may be shared with prospective employers;

  • Electronic communications and data transmission may involve inherent security risks;

  • The Company cannot guarantee absolute confidentiality or data security.

Candidates are responsible for notifying the Company of any confidentiality concerns relating to current employment situations.

6. No Guarantee of Employment

The Company does not guarantee:

  • Job offers;

  • Interview requests;

  • Compensation levels;

  • Specific projects or assignments;

  • Duration of employment;

  • Career advancement;

  • Continued employment.

Hiring decisions are made solely by the employer.

7. References, Background Checks & Screening Coordination

Candidates acknowledge and agree that:

  • The Company and prospective employers may contact professional references provided by the Candidate;

  • Employers may independently verify employment history, certifications, licenses, education, project experience, and qualifications;

  • Certain employers may require background checks, motor vehicle record checks, drug testing, physical examinations, employment eligibility verification, or other screening procedures as permitted by law;

  • The Company may coordinate or facilitate screening processes through independent third-party providers;

  • Screening vendors, clinics, laboratories, and reporting agencies operate independently from the Company;

  • The Company does not perform, interpret, guarantee, or control third-party screening results;

  • Final employment, screening, and hiring decisions are made solely by the employer.

Candidates understand that:

  • Employers may require signed authorizations and disclosures before conducting screenings;

  • Failure to complete required screenings may affect employment opportunities;

  • Screening requirements may vary by employer, project, location, or position.

Candidates are solely responsible for obtaining permission from references before submitting their information.

The Company does not guarantee that employers will use or rely upon any reference information provided.

The Company is not responsible for:

  • Errors or delays caused by third-party screening vendors;

  • Employer decisions relating to screening results;

  • Screening costs unless otherwise agreed in writing;

  • Adverse employment actions taken by employers.

Candidates acknowledge that screening reports and related information may be maintained by employers or third-party providers subject to applicable law.

8. Privacy & Electronic Communications

By using the Company’s services, Candidates consent to receiving communications electronically, including by email, SMS, phone call, and other digital methods.

Candidates acknowledge that:

  • Electronic communications may not always be secure;

  • The Company may retain recruiting records and communications for legitimate business purposes;

  • Information submitted through forms, resumes, uploads, or communications may be stored electronically.

The Company will use commercially reasonable efforts to protect personal information but cannot guarantee absolute security.

9. Equal Opportunity & At-Will Employment

The Company supports equal employment opportunity principles and does not intentionally discriminate based on legally protected classifications under applicable law.

Candidates acknowledge that:

  • Employment opportunities are controlled by third-party employers;

  • Employment relationships are generally “at-will” unless otherwise stated in a written agreement signed by the employer;

  • Either the employer or employee may generally terminate employment at any time, with or without cause or notice, subject to applicable law.

The Company does not guarantee continued employment or specific workplace outcomes.

10. Candidate Conduct

Candidates agree to conduct themselves professionally throughout the recruiting and hiring process.

Candidates shall not:

  • Misrepresent qualifications or experience;

  • Provide false documentation;

  • Harass Company personnel or clients;

  • Circumvent the Company by directly soliciting employers introduced through our services for the purpose of avoiding recruiting fees;

  • Engage in unlawful, discriminatory, threatening, abusive, or fraudulent conduct.

The Company reserves the right to discontinue services to any candidate at any time.

11. Referral Program

The Company may offer referral incentives or bonuses at its discretion.

Unless otherwise stated in writing:

  • Referral bonuses are only paid for qualified placements;

  • Referred candidates must not already exist within the Company’s recruiting system;

  • Referral payments are only issued after the referred candidate completes the required employment period stated by the Company;

  • Referral eligibility, timelines, amounts, and requirements may change at any time;

  • Referral payments may require completion of tax documentation, including IRS Form W-9 where applicable.

The Company reserves the right to deny referral payments in cases involving fraud, duplicate referrals, policy violations, or disputes regarding referral ownership.

12. Third-Party Employers

The Company does not control and is not responsible for:

  • Employer hiring decisions;

  • Workplace safety;

  • Compensation disputes;

  • Employment policies;

  • Payroll practices;

  • Benefits;

  • Scheduling;

  • Jobsite conditions;

  • Employment termination;

  • Actions or omissions of third-party employers.

Candidates are solely responsible for evaluating employment opportunities and accepting positions at their own discretion.

13. Limitation of Liability

To the fullest extent permitted under California law, the Company shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to:

  • Use of recruiting services;

  • Employment decisions;

  • Failure to obtain employment;

  • Employment termination;

  • Compensation disputes;

  • Workplace injuries;

  • Jobsite conditions;

  • Communications with employers;

  • Data transmission or system interruptions.

The Company’s total liability arising out of or relating to this Agreement shall not exceed one hundred dollars ($100).

Some jurisdictions may not allow certain liability limitations. In such cases, liability shall be limited to the maximum extent permitted by law.

14. Disclaimer of Warranties

The Company provides recruiting services on an “as is” and “as available” basis.

The Company makes no warranties, express or implied, regarding:

  • Availability of opportunities;

  • Accuracy of employer information;

  • Hiring outcomes;

  • Candidate-employer compatibility;

  • Continued employment;

  • Website functionality;

  • Uninterrupted access.

To the fullest extent permitted by law, all implied warranties, including merchantability and fitness for a particular purpose, are disclaimed.

15. Independent Decision-Making

Candidates acknowledge that all employment decisions are made voluntarily and independently.

The Company does not provide legal, tax, immigration, financial, safety, or employment law advice.

Candidates are encouraged to independently review employment agreements, compensation structures, benefits, and workplace policies.

16. Website Use

Candidates agree not to:

  • Attempt unauthorized access to Company systems;

  • Use automated scraping tools;

  • Interfere with website functionality;

  • Upload malicious code;

  • Use the website for unlawful purposes.

The Company may suspend or terminate website access at its discretion.

17. Intellectual Property

All website content, branding, text, graphics, logos, and recruiting materials are owned by the Company or its licensors and may not be copied, reproduced, distributed, or used without prior written permission.

18. Arbitration Agreement

To the fullest extent permitted by law, any dispute arising out of or relating to this Agreement or the Company’s services shall be resolved through binding arbitration administered in California under the rules of the American Arbitration Association.

Candidates waive the right to participate in class actions or class arbitration.

Nothing in this Agreement prevents either party from seeking temporary injunctive relief in a court of competent jurisdiction.

If any portion of this arbitration provision is found unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.

19. California Compliance

Nothing in this Agreement is intended to waive rights that cannot legally be waived under California law.

If any provision is found unenforceable under applicable law, the remaining provisions shall remain enforceable to the maximum extent permitted.

20. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of California, without regard to conflict of law principles.

21. Modifications

The Company reserves the right to update or modify these Terms & Conditions at any time.

Updated versions become effective upon posting to the website.

Continued use of the Company’s services after changes constitutes acceptance of the revised terms.

22. Entire Agreement

This Agreement constitutes the entire agreement between the Candidate and the Company regarding recruiting services and supersedes prior discussions or understandings relating to the subject matter herein.

23. SMS Communications Consent

By providing your phone number to the Company, you expressly consent to receive communications from the Company by phone call, text message (SMS), and voicemail regarding:

  • Job opportunities;

  • Interview scheduling;

  • Recruiting updates;

  • Referral program communications;

  • Hiring-related notifications;

  • Account or application updates.

Message frequency may vary.

Standard message and data rates may apply depending on your wireless carrier and plan.

Consent to receive SMS messages is not a condition of employment or use of the Company’s recruiting services.

Candidates may opt out of SMS communications at any time by replying “STOP” to any text message or by contacting the Company directly.

The Company may also send administrative or transactional communications necessary for recruiting operations.

The Company is not responsible for delayed or undelivered messages.

24. Severability

If any provision of this Agreement is found invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

25. Waiver

Failure by the Company to enforce any provision of this Agreement shall not constitute a waiver of future enforcement of that or any other provision.

26. Electronic Acceptance

Candidates acknowledge that submitting forms, resumes, applications, electronic signatures, checking consent boxes, or otherwise electronically interacting with the Company may constitute acceptance of these Terms & Conditions where permitted by law.
